Other Jurisdiction (OJ) International Investigations; Legate Officers, Overseas Document Analysis, Research & More

OJ is a law enforcement acronym for Other Jurisdiction, and usually refers to interstate state or international investigations not OJ Simpson. Federal overseas criminal investigations are conducted through the FBI’s overseas offices called legal attaché or legates. These professionals understand international protocols and local law enabling cross jurisdictional investigations.

Legate Offices & International Investigations

For the private investigator a legate office is not an accessible resource. Unless he’s either a foreign national or has dual citizenship, conducting overseas investigations can be problematical. Many investigators at the private level may have spent considerable time overseas if they have a military or governmental background as a participant or a dependent. International corporations also provide experience in international cultural and legal environments as well as language skills.

Familiarity with Local Laws, Customs & Language

To conduct an international investigation, criminal or civil, an understanding of local laws and legal requirements is a must. Many established international private investigators either have staff familiar with the country of jurisdiction or have established professional contacts with private investigators in that country. For the individual to conduct an international investigation it would be very difficult at best, and more probably hopeless. Rules and regulations vary substantially. An investigation conducted in Moscow may present varying challenges compared to London. Local cooperation will vary considerably, but one advantage is that the most American law is based on English common law, as is the law in the United Kingdom. Language constitutes a primary barrier as well. Third world countries having dictatorial governments that tend to be paranoid of foreign influence or involvement. Corruption is rampant and if the object of your investigation warrants even unofficial protection, you may confront many obstacles and even constructed interference. Caution is the rule when dealing with paranoia and corruption. The only option to conduct a successful international investigation is to retain the services of a private investigation agency that has experience in international investigations or have established a cooperative professional liaison in the foreign country under consideration. Language skills, familiarity with the culture, customs and knowledge of the legal environment is necessary for a successful conclusion to an investigation.

International Civil Investigations

Most international investigations conducted at the private level probably are civil in nature. Direct familiarity with the language, written as well spoken or a contact with a local may aid in records and document research, usually the foundation of any investigation providing both intelligence for conducting further investigation, interviews and may contribute to evidence needed for court presentation.

Document Analysis & Research

Many investigations contain a wealth of information, but most represent a dearth of data. Intelligence operations are similar in that they attempt to gather data or information and reconstruct it into a meaning form. A substantially involved investigation can yield copious material to analyze and organize to further the investigation. Interviews, interrogations, documents and physical evidence require presentation in such a manner as to educate judge and juries as to nature of the crime, or underlying conditions in civil action to arrive at a decision. Fraud and business dealings can be very convoluted and yield a cornucopia of documents.
