It is indeed legal to record a conversation as long as one party in the conversation gives consent for the conversation to be recorded. This means that the private investigator, the person who hired them, or someone else just has to agree to record a conversation that they are involved in for it to be considered legal.

Can a Private Investigator Legally Enter Any Building?

Another thing that we are asked regularly is if we are allowed to go into any building that we want to investigate. Absolutely not! We are not allowed to do anything that would be considered breaking and entering. This comes up when our clients are trying to catch their spouse, boyfriend, or girlfriend cheating on them. We are NOT allowed to take the key to your boyfriend or girlfriend’s house and search their apartment. We have to have permission from the resident. In a marriage the spouse that hired us can allow us access to the home so we are allowed to go in then. If we do not follow the law we will be arrested for breaking and entering.

Can Private Detectives Pose as Police Officers?

Many people believe that it is legal for a private investigator to pose as a police officer. Under no circumstances is this legal. Private investigators do not have the same authority as a police officer. Police officers can access and enforce all sorts of things that it is not legal for private investigators to do. We will be arrested if we try and act like we are a police officer.
